FOLLOWING on from the comments made by Robert Johnston suggesting class action in response to the unlawful prorogation (Letters, September 17), it is very apt that the Scottish Parliament passed the Civil Litigation (Expenses and Group Proceedings) (Scotland) Act in 2018. Legal costs can now be spread across a group of litigants, instead of the burden being on an individual, where the claims are for more than £100,000.

Robert suggests a class action by anyone adversely affected. We are already hearing of proposed domestic abuse legislation for Wales not getting through because of this unlawful prorogation. There will be many in Scotland who will feel the effects of this unlawful action in different ways. Now would be a good time to start getting together and making a list. English Schona Jolly QC has said on Twitter that 13 significant bills have been lost due by prorogation. Alongside domestic violence, stands divorce and important Brexit legislation including trade and immigration.
